TERMS OF SERVICE

Welcome to the direct booking portal of David & David Ltd. By booking accommodation at Garden View Apartments, you agree to the respective terms and conditions outlined below based on your reservation tier.
PART A: STANDARD, SEASONAL & SHORT-TERM RENTAL TERMS
Applicable to all direct consumer bookings, daily, weekly, and short-term seasonal stays.
1. Reservations & Payments
- A 50% deposit of the total rental amount is required at the time of reservation.
- The remaining 50% balance is due exactly thirty (30) days prior to your scheduled arrival date.
- For reservations made fewer than 30 days before arrival, full 100% payment is required at the time of booking.
2. Standard Cancellation Policy
Our standard cancellation policy applies year-round, including designated High Season and Premium Periods (World Creole Music Festival - WCMF, and Carnival):
- More than 14 days before arrival: 100% refund of all paid prepayments.
- Between 7 and 14 days before arrival: 50% refund of paid prepayments.
- Fewer than 7 days before arrival or No-Show: 0% refund; all payments are forfeited.
3. Security Deposit Pre-Authorization
- A pre-authorization hold of US$250 is placed on your payment card one (1) day prior to arrival.
- This hold is automatically voided within two (2) days after departure, subject to a satisfactory property inspection showing no structural damages or omissions.
4. Check-In & Check-Out
- Check-In Time: 3:00 PM
- Check-Out Time: 12:00 PM (Noon)
- Late check-outs are subject to real-time availability and will incur the following fees: Until 2:00 PM is US$25. Until 4:00 PM is US$40. After 4:00 PM is charged at the full applicable daily rate.
5. Guest Responsibilities & Conduct Rules
- Smoking & Pets: Smoking is strictly prohibited indoors. A designated outdoor smoking space is available upon request. Pets are strictly prohibited on the premises.
- Occupancy Limits: Maximum overnight occupancy is strictly capped at four (4) registered guests. Only registered guests are permitted on the property overnight.
- Daytime Visitors: Up to two (2) daytime visitors are allowed on the property between 10:00 AM and 9:00 PM, subject to prior management approval. Parties, public events, or loud gatherings are completely prohibited.
PART B: CORPORATE & LONG-STAY ACCOMMODATION TERMS
Applicable specifically to contracted professional, institutional, NGO, and government stays of 1, 3, 6, and 12 months handled directly via corporate agreement.
1. Corporate Invoicing & Payment Schedules
- First Month Allocation: A 50% deposit of the first month’s corporate lease tier is required to secure the property calendar. The remaining 50% balance of the first month is due thirty (30) days prior to personnel arrival. Bookings executed within the 30-day window require 100% immediate settlement.
- Recurring Billings: Subsequent months are invoiced fifteen (15) days in advance and must be settled via direct corporate bank wire transfer by the first (1st) day of the corresponding service month. All incoming wire fees remain the responsibility of the contracting entity.
2. Institutional Cancellation & Term Adjustments
- Pre-Arrival Cancellations: 100% refund if notice is given over 30 days prior to arrival; 50% refund of the deposit if given 14 to 30 days prior; 0% refund if given fewer than 13 days prior.
- Early Deployment Reductions: If a project concludes early, the organization must provide a minimum thirty (30) days' formal written notice of early departure. Monthly rates will be retroactively adjusted and billed to match the actual duration tier utilized.
3. Corporate Security Escrow & Indemnity
- In lieu of standard card pre-authorizations, corporate clients submit a flat security deposit of US$500 (for 1 to 3-month contracts) or one full month’s rent (for 6 to 12-month contracts) to be held in escrow.
- This deposit is refunded via bank wire within seven (7) business days of a successful checkout inspection. The contracting organization retains full financial liability for accidental damages or negligence caused by their personnel.
4. Operational Flexibility & Continuity Safeguards
- Personnel Substitutions: Organizations may swap out deployed staff seamlessly, provided David & David Ltd is given forty-eight (48) hours' written notice with valid identification for security registry.
- Late Check-Out Grace: Flight-delay allowances up to 4:00 PM are granted on a complimentary basis to corporate guests, strictly subject to prior written approval and availability.
Utility & Infrastructure Allocation: High-speed broadband Wi-Fi and structural water utilities are bundled into the flat monthly rate. To support operational continuity, independent on-site water storage systems are maintained to bypass municipal outages. Electricity consumption is metered independently via DOMLEC sub-meters and billed separately based on actual usage.
PART C: GENERAL LEGAL PROVISIONS
Applicable to all stays, users, and clients of David & David Ltd.
1. Force Majeure
David & David Ltd is not liable for service disruptions or operational failures beyond our reasonable control, including natural disasters, tropical storms, regional utility grid outages, government restrictions, or public health emergencies. If a force majeure event renders the apartment structurally uninhabitable, any unspent, pre-paid nights will be fully refunded.
2. Legal Disclaimer & Intellectual Property
All content on this website is the property of David & David Ltd and is provided "as is" for general informational guidance. We reserve the right to modify rates, seasonal periods, and terms without prior notice.
3. Governing Law
These Terms of Service are executed, interpreted, and governed strictly in accordance with the laws of the Commonwealth of Dominica.
